For the State The grievance of the petitioners is directed for issuance of a certificate under the exempted category. It is submitted on behalf of the petitioners that notwithstanding having served a representation dated 5th December, 2018 on the office of the District Magistrate, Purulia being the respondent No. 2, the said representation has not been considered nor disposed of till date.
Mr. De, learned advocate appears for the State and submits that the petitioners are not entitled to an exempted category certificate in law.
In view of the fact that the petitioners have filed a representation as far back as in 2018 with the respondent No. 2, there is no question of the said representa tion having been kept pending for such a long period of time. It is submitted on behalf of the
State that the petitioners be requested to submit a fresh representation before the respondent No. 2.
In view of the aforesaid, I direct the petitioners to file a fresh representation before the respondent No. 2 within a period of two weeks from date. If such representation is received by the respondent No. 2 within the stipulated time as aforesaid, the respondent No. 2 is directed to consider and dispose of the same in accordance with law within a period of four weeks from the date of receipt of the same.
I make it clear that I have not gone into the merits of the controversies and nothing in this order will influence the respondent No. 2 insofar as the meits are concerned to consider and dispose of the representation of the petitioner in accordance with law.
With the aforesaid directions, W.P.A. 4052 of 2019 is disposed of.
There shall be no order as to costs.
Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
