Affidavit of service filed by the learned advocate for the petitioner is taken on record.

The petitioner alleges that the Pradhan of Bibhishanpur Gram Panchayat being the respondent no.9 is not permitting the petitioner to use water from the submersible pump for irrigation of his land. It has been submitted that the other local cultivators are getting water from the said submersible pump but it is the petitioner who has been discriminated and not allowed to use water from the said submersible pump. In view of the nonsupply of water the land of the petitioner cannot be cultivated and the petitioner is facing acute financial crisis.

The petitioner filed representation before the respondent authorities praying for a direction upon the Pradhan of the Gram Panchayat to supply water

to the petitioner's land but none of the representations have been answered by the respondents till date.

As none appears on behalf of the respondents, the Court is not in a position to ascertain as to why water is not given to the petitioner for cultivation of his land.

Accordingly, the present writ petition is disposed of by directing the Block Development Officer, Bhagwanpur-I, Kajlagarh, Bhagwanpur being the respondent no.7 to take into consideration the representation filed by the petitioner in February, 2021 strictly in accordance with law and the relevant Rules after giving an opportunity of hearing to all the necessary parties within a period of eight weeks from the date of communication of this order and pass a reasoned order and communicate the same to all the parties immediately thereafter.

The petitioner is directed to forward a copy of the representation made to the Block Development Officer in February, 2021 to the aforesaid respondent at the time of communicating the order of the Court. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
