Apprehending arrest in connection with Gazole Police Station Case No.

of dated 30.01.2021 under Sections 354A/506/306 of the Indian Penal Code, the petitioner has filed the instant application for anticipatory bail.

The petitioner has prayed for anticipatory bail in connection with the aforementioned case.

It is submitted by the learned Advocate for the petitioner that he has been falsely implicated in this case. The allegation made against him was absolutely incorrect and he should be released on anticipatory bail.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have carefully perused the Case Diary. The materials in the Case Diary suggest that the petitioner used to disturb the deceased, a married lady for a long time. Even he threatened her and her minor daughter with dire consequences after being warned by the husband

and brother-in-law of the deceased.

In view of such material in the Case Diary, we are not inclined to grant the benefit of Section 438 of the Code of Criminal Procedure. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

The application for anticipatory bail, being CRM 2227 of 2021 is thus dismissed.
