G.S.Das Mr. Dyutiman Banerjee Mr. Vishal Mallick ... for the Petitioner(s) Ms. Sonal Sinha Ms. Munmun Ganguly Mr. Sandipan Das ... for the State-respondent(s) The petitioner is aggrieved by the fact that in T.S. 1 of 2015, the learned Civil Judge (Jr. Divn.), 6th Court, Alipore by way of an ad interim order directed that there should not be any disturbance to the peaceful possession of the suit property which was enjoyed by the plaintiff.
The petitioner complains that there has been violation of the order of the said Civil Court and, to that extent, an application under Section 156(3) of the Cr.P.C.
was filed by the petitioner.
Consequent to which, a case was
registered being Bhangar P.S. Case No.
50 dated 25.01.2015.
The petitioner now prays for execution of the order passed by the learned Civil Judge as there has been violation of the said order.
Having considered that for violation of the order of the civil court, Civil court has enough power in an appropriate application to deal with the same. The petitioner, if so advised, will take out an appropriate application before the learned Civil Court.
The police authorities would only ensure that there is no breach of the peace and/or tranquility taking place as also no untoward incident resulting from the strained relationship existing between the parties.
With the aforesaid observations, WPA 6215 of 2025 is disposed of.
