Learned advocate appearing for the petitioner prays for bail as the complicity which according to the petitioner appear from the materials, hardly makes out any case against him. Learned advocate submits petitioner is unnecessarily detained. Petitioner is a senior citizen and as such he prays for bail.

Learned advocate appearing for the defacto complainant opposes the prayer for bail and submits that it is because of the accused persons the trial could not commenced till date. Learned advocate for the State submits, two of the accused persons are still absconding, as such the stage of consideration of charges could not be overcome. Additionally, it has been submitted that so far as the absconding accused persons are concerned, case has been split up against them. Having regard to the gravity of the offence, at this stage, without the trial commencing, I am not inclined to release the petitioner on bail which may jeopardize the further prospects of the case.

Accordingly, at this stage, the prayer for bail in CRM (M) 614 of 2026 is rejected.

Learned Trial Court would expedite the process and progress of the proceedings.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
