G.S.Das Ms. Pampa Dey (Dhabal) Mr. Biswarup Chatterjee Mr. Satyajit Tripathi ... for the petitioner(s) Mr. Subir Pal ... for the State - respondent(s) The petitioner is aggrieved by the fact that the private respondents are trying to encroach upon his property and physically assaulting him and/or his family members when they resisted the illegal activities and/or atrocities of the private respondents.

The petitioner claims that he has informed the police authorities repeatedly but the police authorities have refused to take any action.

As none appears on behalf of the State, Mr. Subir Pal, learned advocate,

who ordinarily appears on behalf of the State is directed to represent the State.

His appearance may be regularised by the concerned authorities.

In view of the petitioner having informed the police authorities way back in 27.09.2022 and 09.02.2023, I direct that if the situation still exists, the petitioner will forward a letter to the concerned police authorities and a copy of the same to the Deputy Commissioner of Police in charge of Rajarhat police station.

The concerned police authorities would communicate with the petitioner to ascertain regarding the inconveniences faced by them and try to address the issue.

Needless to state that this court has not directed to ascertain regarding the right, title and interest of the property which is the exclusive domain of the learned Civil Court.

The police authorities would ensure that the petitioner is not disturbed, keep a strict vigil and ensure that no breach of the peace and tranquility takes place as also no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 5071 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
