The petitioner is a retired Headmaster of Danga High Madrasah (H.S.), Bonhooghly, District - 24 Parganas (South). The petitioner is complaining nondisbursement of his retiral benefits and pension. Mr. Chattopadhyay, learned Additional Government Pleader duly assisted by Mr. Sabyasachi Mondal, learned advocate, file the instruction they have received from the District Inspector of Schools (S.E.), District - 24 Parganas (South), the respondent no. 3 herein bearing Memo No. L. C. - 685 dated August 24, 2023, let it be kept with the record.

It appears from the said instruction says that two criminal cases concerning the affairs of the school are pending against the petitioner. However, the petitioner before the respondent no. 3 had expressed his willingness to apply for provisional pension.

The petitioner is not entitled the full pension so long the said criminal cases are pending, however he is at liberty to apply for provisional pension, if such an application is made, the respondent no. 3 shall consider the same expeditiously in accordance with law.

W.P.A. 5073 of 2023 is disposed of with the above observations without any order as to costs.
