C.R.R.714 of 2007 D/L29 July 14, Bpg.

In Re: An application under Section 482 of the Code of Criminal Procedure Code, 1973;

Vineet Bagaria

Versus

The State of West Bengal and another Mr. Milon Mukherjee, Mr. Biswajit Manna.

...for the petitioner.

Mr. Arijit Ganguly, Ms. Debjani Sahu.

...for the State.

The revisional application was preferred in the year 2007 in respect of Bantra Police Station Case No.04/2007 dated 10.01.2007.

Today, when the matter has been called, Mr. Arijit Ganguly, learned advocate appearing for the State has submitted a report which reflects that charge was framed in the year 2018 and next date has been fixed on 17.03.2023 for evidence. Let the report be kept with the record.

Mr. Ganguly is directed to hand over a copy of the report so submitted before this Court to Mr. Manna, learned advocate appearing for the petitioner.

Having regard to the fact that more than 15 years have passed in the meantime and the nature of the proceedings which was the subject matter of challenge, I am of the opinion that the present revisional application can be disposed of by granting liberty

to the petitioner to challenge the subsequent stage of the proceedings, if so advised. The present revisional application has become infructuous.

Accordingly, CRR 714 of 2007 is disposed of as infructuous.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
