The present proceeding has been initiated against the petitioner along with the accused company on the basis of the understanding that the petitioner is a Director of the accused company and has intentionally failed to pay the penalty amount under section 15D and 15HB of the SEBI Act thereby making him liable for punishment under section 24(2) read with section 27 of the SEBI Act, 1992. Being aggrieved by the said proceeding learned counsel for the petitioner submits that he was never involved with the accused company in any capacity.

Moreover, every correspondence made to the petitioner with respect to the present proceeding was deliberately made to an address where the petitioner never resided and for which the petitioner could not appear before the court and for which warrant of arrest has been issued against him. However, learned counsel for the petitioner made an innocuous submission that he wants to surrender before the court and to that extent liberty may be given to him.

as such service of copy of application upon the opposite party/SEBI is hereby dispensed with.

In view of above, the instant application being 1021 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the 5th Special Judge, Calcutta within a period of three weeks. If the petitioner surrender before the court below within the stipulated period the court below will dispose of his prayer in accordance with law without being influenced by any observation made herein above. The order by which the warrant of arrest has been issued against the petitioner is hereby stayed for a period of three weeks or till the petitioner surrender before the court below whichever is earlier.
