Learned advocate appearing for the petitioner expresses her anxiety so far as the progress of Misc. Criminal Case No.261 of 2016 under Section 125 of the Code of Criminal Procedure before the learned ADCM, Raigang, Uttar Dinajpur is concerned. More than seven years have passed since the initiation of the case and it is submitted that the private opposite party no.2 in a designed manner has been delaying the progress of the case. It has been further brought to the notice of this Court that in the year 2022 the petitioner prays for interim maintenance but till date she has not received any farthing. The next date is fixed on 8th March, 2024.

In case the application for interim maintenance is pending and the husband who is being examined as OPW1 is not present in court for cross-examination on the next date so fixed, in that case, the learned ACJM, Raiganj, Uttar Dinajpur would dispose of the application for interim maintenance. Learned Magistrate would fix dates as usual twice in a month so that the trial is concluded preferably by 30th June, 2024 and the verdict is pronounced by 31st July, 2024.

With the aforesaid observations, CRR 836 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.
