Despite the matter having been fixed on the ground of urgency at the behest of the petitioner, none appears for the petitioner when the matter is called on for hearing, although the respondent-authorities are represented through counsel.

Mr. Deb Roy, learned counsel appearing for the respondent-authorities, files a report, in the form of instructions, which indicates in detail the steps which the police took regarding the complaint lodged by the petitioner against the private respondents about illegal seizure of the vehicle of the petitioner by the private respondents and their henchmen.

It appears from the report that appropriate action has already been taken by the police-authorities by clubbing the relevant sections of the Indian Penal Code and completing investigation into the matter. Such investigation has culminated in the vehicle-in-question

being re-seized and returned to the petitioner, maintaining due process of law.

As such, it is understandable why the petitioner is not interested to proceed further in the matter. In view of the police having sufficiently mitigated the grievance of the petitioner, W.P.A. No. 4109 of 2020 is dismissed as infructuous.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
