The petitioner is in custody in connection with Beliaghata Police Station Case No. 5 of 2022 dated 22nd January, under Sections 120B/395/397/307 of the Indian Penal Code read with Sections 25(1B)(a)/27 of the Arms Act.

The petitioner's mother has died. He has applied for a temporary parole to perform the last rites of his mother and also to perform the Sradh Ceremony. The Superintendent of Presidency Correctional Home has recommended the release of the petitioner for a period of six hours on the 2nd March, 2023 i.e. today.

Mr. Sarbendra Chakrabarti, Officer-in-charge, Law Cell, Directorate of Correctional Services appears before this Court and submits that a police team has arrived at the correctional facility to escort the petitioner for the parole.

In so far as the prayer for parole for performing the last rites on the 13th day, this Court notes that the petitioner has applied before the learned Sessions Judge in this regard, before whom the application is pending.

It is, therefore, requested that the Sessions Judge shall consider the petitioner's application for such parole in course of this week.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
