The revisional application has been preferred challenging the order dated 07.03.2022 passed by the learned Metropolitan Magistrate, 20th Court, Calcutta in connection with C. Case No.14816 of 2013.

Records of the case reflect that an appeal was preferred before the Sessions Court against an order of conviction and sentence and the said judgment and order of conviction and sentence was affirmed. Petitioner is unable to apprise the court as to whether a deposit has been made in connection with a proceeding which was initiated under the provisions of Section 138 of the Negotiable Instruments Act. As the challenge is relating to warrant of arrest which has been issued, I direct that on deposit of the fine/compensation amount so affirmed by the learned appellate court in respect of the judgment of the learned trial court i.e. the learned Metropolitan Magistrate, 20th Court, Calcutta, warrant of arrest should be recalled.

With the aforesaid observations, CRR 891 of 2022 is disposed of.

All the parties shall act on the server copy of this order duly downloaded from the official website of this court.
