Petitioner surrendered before the Learned Special Court after his anticipatory bail was rejected on 05.01.2026. Petitioner's anticipatory bail was primarily rejected on the ground that apart from the allegation relating to offences under the NDPS Act there were also allegation against the petitioner for harbouring Bangladesh Nationals. It has been submitted by the learned advocate for the petitioner that the petitioner surrendered on 07.01.2026 and has been implicated on the basis of statement of co-accused.
Learned advocate lastly submitted that since charge sheet has been submitted, petitioner may be released on bail on any stringent condition.
Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner in similar type of offences. It has also been submitted that one of the person out of the other two accused persons who are in custody in connection with the instant case belongs to Bangladesh and the other accused who is absconding presently is an Indian.
Having considered the period of detention of the petitioner and that the petitioner surrendered immediately after the anticipatory bail prayer was rejected, I am inclined to release the petitioner on bail.
Accordingly, the prayer for bail of the petitioner is allowed.
Accordingly, Petitioner, namely, Royal Sk., shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Additional District & Sessions Judge, 2nd Court cum Judge Special Court under NDPS Act at Murshidabad at Berhampore. If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not
leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 424 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
