Ms. Tuli Sinha .... for the State Md. Sarwar Jahan, Sk. Nayeemul Haque ...for the respondent no.3 The petitioner is a suspended teacher of a primary school in Murshidabad. He was arrested and detained in custody for more than 48 hours in connection with Sagardighi Police Station FIR No.220/21 dated 8th June, 2021 under Section 302 IPC. The suspension was with effect from 12th June, 2021, that is, from the date of arrest until further order.

According to the petitioner, he ought not to be kept suspended for an indefinite period. No

disciplinary proceeding has been initiated against the petitioner till date.

The grievance of the petitioner is that he has not been paid full salary during his period of suspension. No law has been produced before this Court in support of the submission of the petitioner that he is entitled to receive full salary during the period of suspension.

It will be open for the petitioner to make appropriate application before the Murshidabad District Primary School Council highlighting his grievances.

In the event a representation is made, the same shall be considered strictly in accordance with law, at the earliest, but positively within a period of eight weeks from the date of filing the representation. The writ petition disposed of.
