This revisional application has been filed for expeditious disposal of Title Suit No.79 of 2009, pending before the learned Civil Judge (Junior Division), 1st Court at Barasat.

It is contended by the learned advocate for the petitioner/plaintiff that cross-examination was going on and thereafter, the suit has not proceeded further. Records reveal that the cross-examination of D.W.1 has been going on since September 2019 and the same has not yet been completed.

Under such circumstances, this revisional application is disposed of with a direction upon the learned court below to dispose of the Title Suit No.79 of 2009 expeditiously, preferably within a period of eight months from the last date fixed.

It is made clear that this Court has not gone into the merits of the case and the learned court below shall decide the entire dispute independently and in accordance with law.

The petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite parties within this week.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
