Learned advocate appearing for the petitioner submits that the petitioner undertakes to appear before the learned trial court on each and every date so fixed in connection with Parnashree Police Station Case No. 238 dated 04.08.2015. The said proceeding is under Sections 498A/406 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The said case is presently pending before learned Judicial Magistrate, 6th Court, Alipore.

Having considered that the case was registered in the year 2015 and charge-sheet was submitted in the year 2016 and no witness has been examined till date, I direct the learned trial court to fix one date in a month for the purposes of the present case and grant opportunity on three dates for appearance of the witness concerned and take the trial of the case to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

It has been informed that there are five witnesses who have been relied upon by the prosecution in order to prove its case. Learned trial court before closing the evidence would

inform the jurisdictional police station to take steps for making the witness available, receive a report and thereafter close the evidence. The concerned Officer-in-Charge would respond immediately on the directions passed by the learned trial court for supplying the report regarding the availability of the witness concerned.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders should cooperate with the learned trial court to conclude the trial at the earliest.

The trial of the case would continue in spite of the resolution of the local Bar and the participating advocates will not stall the proceedings in any manner whatsoever. With the aforesaid observations, the revisional application being CRR 840 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
