The CRAN application being no.1 of 2019 (Old No.CRAN 2923 of 2019) pertaining to restoration is the subject matter to be addressed by this Court.
It is brought to the notice of the Court that on 31st July, 2019, the case was dismissed for default without considering the merits of the case, if there be any. The restoration application was filed on 5th Autust, 2019, the copy of which is now made available to learned advocate representing State, the names of whom are mentioned hereinabove. The reasons of non-appearance have been clarified in the relevant CRAN application filed for the purpose.
Learned advocate representing the State submits that the disposal of the case was without going into the merits of the case. Having considered the submission of both sides let the CRAN application be disposed of directing the revisional application being No.CRR 565 of 2019 be restored to its original file and number.
Matter to appear in the list under the heading "Listed Motion" one week after.
Copy of the revisional application be immediately served to the learned advocate representing the State to effectively address the issue involved in the revisional application. (Subhasis Dasgupta, J.)
