This is an application where the petitioner has prayed for expeditious disposal of the complaint case no. C-229 of 2022, presently pending before the learned Judicial Magistrate, 1st Court, Sealdah under Sections 420/406/385/506 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the complaint was filed on 7th July, 2022 and thereafter, the learned court below after examining the complainant and his witnesses under Section 200 of the Code of Criminal Procedure, was pleased to postpone the issuance of process and directed the Officer-in-charge, Beniapukur Police Station to enquire into the matter and to submit a report but till date, no report has been submitted and the next date is fixed on 1st December, 2025 for submission of report. In such circumstances, she has prayed for a direction upon the court below for expeditious disposal of the said complaint case.
Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and required to be allowed for the ends of justice. In such view of the matter, CRR 1036 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the abovementioned complaint case and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
