Ms. Debjani Sahu ...for the State In terms of order dated 9th February, 2022 Ms. Sudeshna Basu Thakur, learned advocate has deposited photostat copies of the order passed by the learned Special Judge, C.B.I., Court No.1 at Alipore on 2nd March, 2022 and the copy of the challan in T.R. Form No.7 to show that the appellant has already deposited the fine amount. On the last occasion, the learned advocate for the State filed a report from the concerned correctional home informing, inter alia, that the appellant has already served the substantive sentence of imprisonment.

However, on sufferance of sentence an appeal does not end. The appellant still has the right to challenge the order of conviction. Therefore, the learned advocate-on-record is directed to take instruction from the appellant as to whether he will proceed with the instant appeal assailing the order of conviction passed by the trial Court against him. The matter be fixed on 16th March, 2022 for order.

Photostat copies of the document filed by Ms. Sudeshna Basu Thakur, learned advocate be kept with the record.
