Heard learned counsels for the parties.
The petitioner is in custody for more than 2 years and prays for bail.
Learned counsel for the petitioner submits that he was named by the co accused and the only incriminating material against him is that he purchased the mobile phone of the deceased. The mobile phone seized from his custody contains a SIM in his name.
Learned counsel for the State opposes the prayer. It appears that the offending weapon as well as other material connected to the case has been recovered pursuant to the leading statement of the petitioner and the co accused. The finger prints at the place of occurrence matched with that of the petitioner.
In view of the clinching evidence connecting him to the alleged offence, prayer for bail of the petitioner is rejected at this stage.
The learned trial Court is directed to expedite the trial, without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application for bail is thus disposed of. Case diary be returned.
