Suhas Chandra Basu v. Joydeb Das
Court No. 6 CO 801 of 2025 (265719) 07.03.2025 Suhas Chandra Basu Vs.
Joydeb Das (AD 20) (S. Banerjee) Mr. Lal Mohan Hajra Mr. Somesh Pariya Ms. Anuradha Hajra Ms. Moutusi Hazra ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned 2nd Civil Judge (Sr. Division) at Barasat to dispose of Title Suit No. 380 of 2016 expeditiously.
After going through the order-sheets appended to this application this Court finds that April 4, 2025 has been fixed for hearing on acceptance of the show cause by the defendant.
In view of the order sought and proposed to be passed, this Court feels that there is no necessity to pass any order directing issuance of notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application, along with a copy of this order, upon the opposite party or upon the learned advocate
representing the opposite party before the learned trial Judge.
Considering the fact that the suit is for eviction and is pending since 2016, CO 801 of 2025 is disposed of by requesting the learned 2nd Civil Judge (Sr. Division) at Barasat to dispose of Title Suit No. 380 of 2016 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
