The petitioner has challenged the decision of the State Transport Authority, which is at page 13, wherein his vehicle having BS-III norms complied was not granted the permit. However, from another entry in the said page in respect of another vehicle the petitioner submits that the other gentleman in serial no. 89 (the petitioner's serial no. is

90) was granted option to place BS-IV norms complied vehicle, which opportunity has not be given to him. Learned advocate for the respondent submits that the reasons disclosed in pages 14 and 15 is not applicable to him as the name of the petitioner is nowhere indicated in this annexure at pages 14 and 15 of the writ application. After hearing the parties, I direct the respondent

no. 4 to reconsider the matter whether the petitioner is required to place a BS-IV norms complied vehicle before them for getting the permit or not. Such reconsideration is to be made by ten weeks from date and decision thereon is to be communicated to the petitioner two weeks thereafter. With this above observation, the writ application is disposed of without any order as to costs. (Abhijit Gangopadhyay, J.)
