It appears that the work of shifting of the electric pole is being done by an agency of the West Bengal State Electricity Distribution Company Limited at the request of the P. W. D. Such work was necessary for widening of the P. W. D.'s Road at Mangalbari Area, under Old Malda Municipality. The concerned electric line is the 11 kV Mangalbari feeder, originating from Narayanpur's 33/11 kV Sub Station, under the jurisdiction of South Malda Division of WBSEDCL. The old pole was uprooted and a new pole was erected in the land of the PWD. The pole is not in the property of the petitioner.

Under such circumstances this court holds that the petitioner cannot have any grievance. The egress and ingress to the petitioners' petrol pump should be free and there should not be obstruction for the vehicles to access the petrol pump run by the petitioner.

The writ petition stands disposed of.
