The Advocate-on-record of the petitioner undertakes to affirm and stamp the petition/application as per the Rules within four weeks from date. Subject to such undertaking, the application is taken up for hearing.

This is an application for bail on behalf of the petitioner. It submitted by the learned Advocate for the petitioner that the petitioner is a habitual drug addict and he committed such offence as a result of addiction in his young age. It is also submitted that he should not be confined to the correctional home, on the contrary the Court should take proper step for his rehabilitation and mental treatment.

Learned Public Prosecutor has raised serious objection against the prayer for bail.

On careful perusal of the case diary, it appears that the

petitioner was identified in Test Identification Parade. The witnesses made their statement under Section 161 of the Code of Criminal Procedure and stated the extent of complicity against the petitioner. Considering the materials in the case diary, we are not inclined to release the petitioner on bail.

The application for bail being CRM 2236 of 2021 is rejected. (Harish Tandon, J) (Bibek Chaudhuri,J.)
