Affidavit-of-service filed on behalf of the petitioner is taken on record.

Husband of the petitioner went missing on 13.09.2025 and his body was recovered on 15.09.2025. A missing case was registered under Farakka PS vide Farakka PS GDE No. 1095 dated 14.09.2025. On 15.09.2025 husband's body was recovered from a pond and ultimately an FIR was registered being Farakka PS case no. 442/25 dated 16.11.2025 under Sections 103(1)/238 BNS. However, on behalf of the petitioner dissatisfaction is expressed regarding the investigation being carried out by the concerned police authority. Prayer is made for directing higher police authority to monitor the investigation.

One communication dated 29.03.2026 of Inspector of Police, IC Farakka PS, Jangipur Police District is filed before this Court and the same is taken on record, copy
of the same is made over to the learned advocate representing the petitioner.

It is disclosed in the said communication dated 29.03.2026 that certain steps have been taken while investigating the case by the concerned investigating officer and on 23.03.2026 one FIR named person being respondent no. 9 was arrested and he is now in jail custody. It is submitted on behalf of the police authority attempts were made to arrest other accused persons but till date they could not be apprehended.

In view of the steps taken by the investigating officer in connection with Farakka PS case no. 442/25 dated 16.11.2025 it ought not to be concluded that steps are not being taken. However, the concerned investigating officer is directed to expedite the investigation and take the same to its logical conclusion.

It is also disclosed in the communication dated 29.03.2026 that on 11.12.2025 investigating officer sent viscera of the victim to the Director, Forensic Science Laboratory for examination and opinion which is found to be required in the continuing investigation but till date report is not forwarded by the Director, Forensic Science Laboratory.
Though Director, Forensic Science Laboratory is not made party in this writ petition but petitioner shall also be at liberty to approach the Director, Forensic Science Laboratory for forwarding its report at an early date. In addition thereto investigating
officer is directed to send another letter to the Director, Forensic Science Laboratory to submit a report. 7.
In the event such communications are made addressed to the Director, Forensic Science Laboratory, it is expected that the Director shall take necessary steps by forwarding its report and view immediately thereafter. 8.
If investigation is not concluded within a reasonable time, leave is granted to the petitioner to take steps in accordance with law.

With the aforesaid observations, writ petition stands disposed of.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
