None appears for the parties even in the second call. It appears that the parties did not appear even on the earlier occasion, that is, on 1st July, 2021. Accordingly, the Coordinate Bench directed the matter to be listed under the heading "For Dismissal" on 5th July, 2021.
Since the appellant is not represented nor any accommodation has been prayed for on behalf of her, it is presumed that the appellant is not interested to proceed with the appeal.
Under such circumstances, the appeal being FMA 3605 of 2014 stands dismissed.
However, there shall be no order as to costs. Moreover, it appears from the status report of the case that the suit was fixed on 17th June, 2019 for completion of cross-examination of PW1.
In view of the substantial progress being made in trial, we request the learned Trial Judge to dispose of the suit as expeditiously as possible.
The Office of the Registrar Administration (L&OM) is directed to communicate this order to the learned Judge, 13th Bench, City Civil Court at Calcutta.
