This revisional application has been filed with a prayer for expeditious disposal of Title Suit No. 215 of 2010, pending before the learned Civil Judge (Junior Division), 3rd Court, Howrah along with all other pending applications.

It appears from the records that an application under Order 26 Rule 9 of CPC is pending. It is further submitted that another application under Order 6 Rule 17 of the CPC is also pending since 2015.

The prayer of the petitioner is innocuous.

Hence, the revisional application is disposed of with a direction upon the learned court below to dispose of the pending applications within three months from the next date fixed upon allowing all the parties to contest the said proceedings. Upon disposal of the interlocutory applications the learned court below shall proceed expeditiously with the

disposal of the Suit and dispose of the same preferably within one year thereafter.

This court has not gone into the merits of the claims of the petitioners and the learned court below shall decide the matter in accordance with law and independently.

The petitioners are directed to serve a copy of the revisional application along with the server copy of this order upon the opposite parties within a week from date.

The revisional application is disposed of. There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible subject to compliance of all usual formalities.
