Md. Ali Mansoor ...for the petitioner Counsel for the petitioner seeks a direction upon the Bowbazar Police Station to implement the order of the Additional Chief Metropolitan Magistrate, 2nd Court, Calcutta, into the GR Case No. 1262 of 2015 arising out of FIR No. 426 dated October 11, 2015.

It is now well-settled that the Magistrate can order further investigation under the provisions of Section 173 of the Cr. P.C. and not a reinvestigation. The order of the Magistrate shall be treated as an order for further investigation by the Bowbazar Police Station.

Let a report be submitted by the Bowbazar Police Station to the concerned Magistrate in terms of the direction dated April 13, 2018, within a period of months from the date of communication of a copy of this order.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
