Matter relates to transfer of the petitioner based on application made on Utsashree Portal on 3rd December, 2022. Transfer application was made on the ground of distance in between the present school of the petitioner and his place of residence. It is further contended that the school authority where petitioner is presently working forwarded the transfer application of the petitioner on 20th December, 2022 to the District Inspector of Schools (SE) Paschim Medinipur being respondent no. 5 but thereafter respondent no. 5 did not take necessary steps by forwarding
the transfer application to the West Bengal Central School Service Commission.
The learned advocate representing the State respondents has submitted due to suspension of portal steps could not be taken by forwarding the transfer application of the petitioner to the West Bengal Central School Service Commission upon processing the same.
Having considered the submissions made on behalf of the parties writ petition stands disposed of directing District Inspector of Schools (SE) Pashim Medinipur to forward the transfer application of the petitioner to the West Bengal Central School Service Commission by fortnight from the date of communication of this order. On receipt of transfer application Chairman, West Bengal Central School Service Commission being respondent no. 4 shall decide the same in accordance with law by 6 (six) weeks thereafter and the decision to be taken by the respondent no.4 shall be communicated to the petitioner by 10 days thereafter.
It is made clear the suspension of portal shall not be a ground to reject transfer application of the petitioner.
Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
