Samidh Banerjee v. State Of West Bengal
IN THE HIGH COURT AT CALCUTTA
Criminal Revisional Jurisdiction 12-07-2022 Subha Item no.01 Ct no.34 CRR 562 of 2008 Samidh Banerjee -versus- The State of West Bengal & Ors.
Mr. Somopriyo Chowdhury Mr. Dipayan Dan ....for the petitioner.
The revisional application was preferred challenging the order dated 13.09.2007 passed by the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24 Parganas in Case No. C-157 of 2007 .
The impugned order reflects that the learned Magistrate after perusal of the petition of complaint, initial statement of the witnesses and the documents filed therein was of the opinion that the dispute complained of is civil in nature and as such dismissed the petition of complaint.
Having regard to the time period which has passed since the impugned order was passed by the learned ACJM, Bidhannagar and the specific observations made therein which is almost 15 years ago, I am of the opinion that no interference is called for at this stage. Mr. Chowdhury, learned advocate appears on behalf of the petitioner but he is unable to apprise this court regarding the service effected pursuant to the order passed on 22.09.2021. Having regard to the overall circumstances, I am of the opinion
that no interference is called for at this stage and the present revisional application being CRR 562 of 2008 is dismissed. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
