Petitioner Mr. Biswajit Manna ... for the petitioner Mr. Biswajit Manna, learned Counsel for the petitioner submits that despite his best effort he could not procure the death certificate of the petitioner, Keshaw Pandey, who has been arrayed in complaint case No.C-1739 of 1999 pending before the learned Metropolitan Magistrate, 17th Court, Calcutta as an accused. He has personal knowledge about the factum of death of Keshaw Pandey.

Mr. Manna is the officer of this Court and I feel no hesitation to act on his submission about his personal knowledge as to the death of the petitioner. Keshaw Pandey, since deceased, was the sole accused person in the complaint case. The case by operation of law has been abated with the death of sole accused person. Therefore, this criminal revision has lost its relevance. With the aforesaid observations, this revisional application is disposed of.

Copy of this order be sent to the Court of the learned Metropolitan Magistrate, 17th Court, Calcutta for taking necessary steps.
