1. Learned counsel appearing on behalf of the petitioner submits as follows. The maternal aunt of the petitioner was deserted by her husband. Thereafter, she started staying at the petitioner's place. After some time, she committed suicide. The husband who had deserted the said victim subsequently lodged the FIR against all those persons who had given a helping hand to the victim. At the relevant time, the petitioner was employed at Kolkata and was not present at the place of occurrence. A similarly circumstanced accused was granted anticipatory bail by this Court on 27/2/2026 in CRM (A) 527 of 2026.
2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the postmortem report and the statements of witnesses.
3. Considering the above and the fact that a similarly circumstanced co-accused has been granted anticipatory bail by this Court earlier, I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O as and when required.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
