1. Affidavit of service filed by the petitioner be kept with the record.

2. The writ application has been preferred against an order No. 63 dated November 26, 2025 passed by the Judge. 2nd Labour Court, Calcutta.

3. Vide the impugned order, the Labour Court considered a petition dated 17.10.2025 filed by the petitioner herein praying for withdrawal of the restoration application, on the ground that address of the opposite party therein was not correct.

4. The Court being not satisfied in respect of the said ground made out for such withdrawal, rejected the said application.

5. On hearing the learned counsel for the petitioner and on perusal of the materials on record, this Court finds that the

restoration application is still pending before the 2nd Labour Court for adjudication, as the same has not been permitted to be withdrawn by the Court.

6. Petitioner's prayer before the Court was that the opposite party's address in the restoration application, did not match with the address in the original application and that was the reason for withdrawal.

7. Considering the said facts, the writ application is disposed of with liberty granted to the petitioner herein to amend the address of the opposite party in the restoration application and the Labour Court shall grant such permission to correct the address of the opposite party on the same being filed.

8. The Court shall then proceed to dispose of the restoration application expeditiously, upon due service, in accordance with law.

9. WPA 5600 of 2026 stands disposed of.
