The petitioner says that there was no recovery of contraband items from him. He has been implicated on the basis of the statement made by the co-accused. Learned Counsel for the State points out with reference to the case diary that the vehicle from which the contraband articles of more than commercial quantity was recovered, is registered in the name of the petitioner.

In view of the aforesaid, we are not inclined to allow this application also keeping in view the provisions of Section 37 of the NDPS Act.

The prayer for anticipatory bail stands rejected. C.R.M. No.2242 of 2021 is, accordingly, dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Suvra Ghosh, J.) (Arijit Banerjee, J.)
