The petitioner is a permanent employee of Government of West Bengal. The petitioner is aggrieved with the action on the part of the employer. The grievances of the petitioner falls under the service matter as enumerated in section 3(q) of the Administrative Tribunal Act, 1985 (hereinafter referred to as the said Act). The petitioner therefor has to ventilate his grievances before the West Bengal Administrative Tribunal in view of the provisions of Section 15 of the said Act. This Court therefor lacks jurisdiction to receive, try and determine the writ petition.

The writ petition is dismissed as withdrawn with liberty to file afresh on the selfsame cause of action before the appropriate forum.
