Rousana Bewa & ORS v. Kutub Dafadar & ORS
SAT 74 of 2008 Item-25.
CAN 1 of 2021 19-05-2023 Rousana Bewa & Ors.
sg Ct. 8
Versus
Kutub Dafadar & Ors.
Mr. Dinendra Nath Chatterjee, Adv.
...for the appellants We have heard the learned Counsel appearing for the appellants.
The appellate decree affirming the judgement and decree of the trial court in a suit for injunction is the subject matter of challenge in this second appeal. On careful reading of the judgments of the both the courts and more particularly, exhibits 1 and 2 read with subsequent FOR, it appears that the possession and title of the plaintiffs in relation to the suit property could not be questioned.
On such consideration, we do not find any reason to interfere with the concurrent finding of facts with regard to possession and title of the plaintiffs.
The appeal stands dismissed at the admission stage. (Uday Kumar, J.) (Soumen Sen, J.)
