The petitioner is aggrieved by the fact that her application for transfer has been rejected on the ground that she is the single teacher of the subject in the school.

Counsel for the petitioner would argue that her application is dated prior to August 2021 and hence the new Rule does not apply.

Now, it is well-settled that transfer is not a matter of right and is subject to administrative exigency and the interest of the students.

In these circumstances, the petitioner shall be at liberty to apply afresh for transfer through Utsashree portal and the same shall be dealt with in terms of the circular of the Government dated 3rd January 2022.

The application of the petitioner shall be treated as a new one. The earlier application made

by the petitioner shall be ignored by the concerned District Inspector of School.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
