This revisional application has been filed by the petitioner challenging order dated 17.12.2014 passed by the learned Judicial Magistrate, 4th Court, Barrackpore, 24Parganas(North). The factual matrix of the case is that the petitioner filed an application challenging the maintainability of the proceedings under Section 125 of the Code of Criminal Procedure on the ground that the opposite party no. 2 was remarried and she along with her minor daughter is residing along with her present husband.

The aforesaid application was rejected by the Judicial Magistrate, Barrackpore. Hence, this revisional application.

It appears from the impugned order that the learned Judicial Magistrate, Barrackpore while rejecting the application held that the petitioner being the father of the minor child is under obligation to provide maintenance. The order so passed by the learned Judicial Magistrate, Barrackpore does not call for any interference. Accordingly, the revisional is dismissed.

All connected applications stand disposed of. Interim order, if any, stands vacated.
