Mashara ......for the petitioner Mr. Sandipan Banerjee Mr. Ankit Sureka .....for the Howrah Municipal Corporation The present writ application has been preferred praying for direction upon the Howrah Municipal Corporation/respondents to initiate demolishing proceedings in respect of the unauthorized construction made by the private respondent.

A report as directed has been filed by the Howrah Municipal Corporation wherein it has been stated as follows.

" Upon inspection on 14.01.2025, it is found that no construction has been carried out at present. A G+1 building has been found at the premises in nature of lodge and seems to be an old one, photos has been attached. However at present no file has been found in this borough office and for the said reason some time may be allowed to conduct a joint inspection and

hearing in this regard and collect further details about it."

The learned counsel appearing for the petitioner submits that a representation dated 13.02.2019 had been made by the petitioners with the respondent authorities but no action has been taken.

Considering the report of the Howrah Municipal Corporation and the nature of relief prayed for the writ application is disposed of with the direction that the respondent authorities shall consider the representation of the petitioner dated 13.02.2019 and dispose of the same within 60 days from the date of this order on giving proper hearing to all the stakeholders and pass an order in accordance with law.

The result of the hearing be informed to the parties concerned.
