No. 29 KAUSHIK DISPOSED OF C.R.M.(A) 982 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Katwa Police Station Case No. 504 of 2022 dated 03.08.2022 under Sections 3(r)(s)(u) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

And In Re : Ramen Talukdar ...... petitioner Mr. Aniket Mitra Mr. Ananda Dulal Sarkar ....for the petitioner Mr. Saryati Dutta ....for the State The police complaint makes out a prima facie case, which require investigations.

The incident, apparently, occurred in public view. Therefore, in view of the restrictions under Section 18 of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, we do not find the present application to be maintainable.

In such circumstances, CRM (A) 982 of 2023 is disposed of.
