Learned advocate appearing for the petitioner submits that the petitioner is in custody for three years and there has been variance in the evidence of the mother of the victim girl as well as from the statement under Section 164 of Cr.P.C. which was deposed in course of the investigation. Unnecessarily, according to the learned advocate, petitioner is languishing in jail and as there is no possibility of the case being taken to its logical conclusion within a reasonable period of time, petitioner as such may be released on bail on any stringent conditions.

Learned advocate for the State submits that all the prosecution witnesses have been examined and date has been fixed for examination of the accused under Section 313 of Cr.P.C. Having considered the advanced stage of the proceedings, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM(M)625 of 2026 is dismissed.
