Petitioner is aggrieved by the fact that till date the application for interim maintenance which has been preferred in connection with Misc. Case No. 395 of 2022 has not been disposed of by the learned Judicial Magistrate, 4th court, Howrah. In view of the period of time which has elapsed and the purpose for which the legislature incorporated Chapter IX of the Code of Code Criminal Procedure, I am of the opinion that the application for interim maintenance be heard out and disposed of within a period of one month from the next date so fixed. Needless to state that in case there is a strategic design made by opposite party for not filing the written objection or affidavit of assets and liabilities, learned Magistrate will proceed with the hearing of the application of interim maintenance and dispose of the application within the timeline stated above. It is reiterated that the learned Magistrate would be at liberty to fix as many number of dates but will not stretch the timeline as directed above.

With the aforesaid observations, the revisional application

being CRR 846 of 2024 is disposed of.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
