Petitioner approached this Court as the statement of the minor was not recorded before the Judicial Magistrate. The same although, do not give a cause of action for invoking Article 226 of the Constitution of India but as has been submitted on behalf of the State that the statement of the minor has been recorded under Section 164 of the Code of Criminal Procedure before the learned Civil Judge (Junior Division), Tehatta as per direction of the learned ACJM. Tehatta.
Having considered that the petitioner's primary grievance for approaching the Court has been addressed, I am of the view that further pendency of the writ petition is unwarranted. The investigating authorities will take the investigation of the case to a logical conclusion within a reasonable period of time.
With the aforesaid observations WPA 5260 of 2025 is disposed of.
