It is not in dispute that the private respondent is the owner of the land in which, according to the petitioners, he has raised a temporary structure obstructing the ingress and egress of the petitioners.

Learned counsel for the private respondent submits that the land was leased out to her husband in 1999 along with the temporary structure thereon. The petitioners admittedly purchased their property in 2016.

Upon consideration of the submission made on behalf of the parties, this Court is of the view that the dispute between the parties is a private dispute and has no

public element herein. The petitioners are at liberty to approach the appropriate civil forum for redressal of their grievance.

The writ petition is not maintainable and is accordingly dismissed.

There shall, however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
