Heard learned counsels for the parties.

The writ petitioners seek compliance of the office memos issued on 14th July, 2022 and 9th September, 2022.

It appears that the memos have been issued in compliance with an order passed by the learned Additional District Judge, 13th Court, Alipore on 3rd June, 2022 in Title Suit No.27 of 2018.

The said order records that the plaintiff, who is the private respondent herein, submitted before the learned Trial Court that he has no claim against Mahindra & Mahindra Ltd. and no grievance or objection if Mahindra & Mahindra obtains licence by following the norms. It is needless to mention that the State respondents do not and cannot have any objection to implementation

of the memos issued by the Director, Transport Department unless and until the same is varied by issuance of any subsequent memorandum.

In view of the above, the writ petition is disposed of directing all the R.T.O.s, being respondent Nos.2 to 35 herein, to comply with/implement the memos issued by the Director, Transport Department on 14th July, 2022 and 9th September, 2022 respectively provided no subsequent memorandum in variance of the same has been issued by the authority subsequently.

With the above directions, the writ petition being W.P.A. 5195 of 2023 is thus disposed of.

However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
