Mr. Bidyut Kumar Ray Ms. Rita Dutta ..........for the State The nephew of the petitioner has love affair with the victim girl who was aged about 17 years and few months on the date of alleged commission of offence.

The guardian of the victim girl was in the process of arranging her marriage with some other person. The victim girl informed the matter to the principal accused, her boy friend. Matrimonial uncle of the principal accused is the neighbour of the victim girl. The victim girl informed the present petitioner that her parents are trying to settle her marriage with another boy. Then she married to the principal accused on the advise of the present petitioner on 13th January, 2022.

Though the victim girl is a minor, but she is on the verge of attaining majority. She left her house on her own accord to marry her boy friend, namely, Raj.

Considering the role of the petitioner and submission made by the learned advocate for the petitioner and the learned Public

Prosecutor-In-Charge, I am inclined to release the petitioner on bail.

The petitioner may find bail of Rs.10, 000/- (Ten Thousand only) with one surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Arambag with a further condition that he shall file an affidavit stating his residential address, Mobile Phone No., Aadhaar Card No. etc. to the court below. The petitioner is also directed to attend the trial court on all dates of trial, failing which the order of bail shall be cancelled.

The application is thus disposed of.
