Petitioner is aggrieved by the inaction of the private respondent nos. 3 and 4, so far as the proceedings relating to G.R. Case No. 4926 of 2024 (Kultali Police Station case no. 499/2024) and G.R. Case No. 5843 of 2024 (Kultali Police Station case no.599/2024) are concerned.

Learned advocate appearing for the State submits that in both the cases charge-sheet have been submitted before the Jurisdictional Court.

It has been submitted on behalf of the private respondent that the accused persons have been released on bail by the Jurisdictional Court concerned. Petitioner further complains that he has made a representation to the Inspector-in-Charge, Kultali Police Station as well as the Superintendent of Police, Baruipur Police District. Petitioner also approached the learned ACJM, Baruipur, the learned ACJM, Baruipur refused to interfere with the prayer under Section 156(3) of Cr.P.C./ Section 175(3) of BNSS.

Having considered the same, I am of the view that the petitioner would be at liberty to ventilate his grievance in the revisional jurisdiction. So far as the other contents of the petitioner are concerned relating to threat and insecurity, if an appropriate application is made before the learned Magistrate, Baruipur, learned ACJM, Baruipur would under the Witness Protection Scheme, 2018 will call for a Threat Perception Report and take steps in accordance with law.

With the aforesaid observations WPA 5264 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
