Case No. 11 of 2022 dt. 7.1.2022.

There is no illegality in the order passed by the ld. Assistant Sessions Judge, 1st Court, Malda.

However, as an undertaking has been made, I grant an opportunity to the petitioner to appear and/or surrender before the Ld. Assistant Sessions Judge, 1st Court, Malda by 15th of April, 2024.

In case, the petitioner appears and the ld. Magistrate finds that the petitioner was earlier on bail, he may be allowed to continue with the same bail and bond subject to condition that he shall meet with the inspector in charge of Habibpur P.S. once in a week for a period of three months.

The petitioner shall be physically present on each and every date henceforth as fixed by the ld. Trial court and will cooperate with the trial of the case.

In case, the petitioner do not appear and/or surrender by 15th of April, 2024 before the ld. Assistant Sessions Judge, 1st Court, Malda, in that case, the ld. Assistant Sessions Judge, 1st Court, Malda would be at liberty to issue harsher process of law by adhering to Section 82 of the cr.p.c.

With the aforesaid observations, CRR 892 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
