Petitioner being aggrieved by inaction of the police authorities approached this Court. The main grievance of the petitioner was that cognizable offence was made out at the behest of the private respondents and inspite of the same no steps have been taken.

State has submitted a report which reflects that Gaighata Police Station Case no.

153/25 dated 17.02.2025 has been registered for investigation under the different provisions of BNS. According to the report submitted on behalf of the State statements have been recorded. There is a part of the investigation which relates to collection of documents, the same is not properly reflected in the report so submitted before this Court.

Learned advocate appearing for the private respondent submits that he has sufficient documents in his custody to rebut the contention as has been advanced in the FIR.

Be that as it may as the FIR was registered after a considerable period of time and the report do not reflect that documents have been collected by the investigating officer properly till date, I am of the view that a Superior Officer of the police in the rank of Additional SP/SDPO In-Charge of Gaighata Police Station will monitor the case and will submit a progress report before the Jurisdictional Court once in a month till the investigating agency comes to a conclusion.

With the aforesaid observations WPA 5268 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
